The Company seeks a lawyer to join our legal team, who is highly motivated, collaborative, who will work strategically within the company’s internal teams, and who will support and work directly with the Company’s General Counsel based in the USA and the Legal Director based in Brazil.
We are seeking a Legal Counsel in Brazil with at least 5 years practicing law whose key responsibility is to serve as a legal advisor and business partner to the Company, and engaging directly with internal clients and external parties, including members of the Company’s Leadership Team, customers, suppliers and external counsel. The Legal Counsel will provide legal expertise in contracts, employment law, regulatory support within the telecommunications sector, and other ad-hoc support in Brazil. The ideal candidate will have prior experience counseling on regulatory matters and related matters with ANATEL and the sector.
The position requires fluency in English.
The position requires availability for periodic meetings with the local team in Brazil and with the Legal Director (no set frequency, but ideally at least once a month).
Essential Functions
* Draft, review, negotiate and manage a high volume and wide variety of contracts. This includes agreements with the Company’s customers and suppliers, with strategic partners, strategic projects, HR-related contracts, etc.
* Support with legal review of local policies and procedures that ensure compliance with local laws and regulations, not only related to ANATEL regulatory matters, but also LGPD compliance, among others. Support with related trainings, as needed.
* Support with management of external counsel and support monitoring, handling and resolving disputes and claims including pre-litigation and litigation disputes on all civil, tax, labor, and telecom regulatory matters.
* Support the Company’s compliance obligations under Brazil telecom regulatory law and related matters, including monitor pending and new laws, regulations, decisions and government and regulatory enforcement activities, and provide proactive and strategic support and guidance to the leadership team.
* Generate reports, presentations, spreadsheets, memos and other documents for the Legal Department, interna/external clients, and the senior management as requested.
* With the support of external lawyers when needed, provide legal guidance on employment matters, including hiring, terminations, compensation/benefits, union relations, safety and health requirements, among other related matters. In addition, advise and implement proactive strategies for labor risk prevention and support securing compliance with local labor laws.
* Participation and support in strategic projects, network expansion, and new products/services.
* Advise business colleagues on various initiatives to advance the Company’s strategy while addressing legal risks and protecting the Company’s integrity and reputation.
* Serve as a “wise counsel” offering good judgement and practical legal solutions to challenges faced by the Company.
Minimum Requirements
* Brazilian law degree, with active OAB (Brazilian Bar Association) registration.
* Minimum of 5 years of experience, preferably as in-house lawyer in the telecommunications or technology sector, or law firm with a strong regulatory focus.
* Knowledge of Corporate and Contract Laws; and Regulatory Law (ANATEL) will be a plus.
* Knowledge of LGPD (Brazilian General Data Protection Law) and compliance will be a plus.
* Fluent English.
